This is a legally binding Release, Waiver, and Assumption of the Risk Agreement (“Agreement”) that I make to Bailey’s Fine Jewelry. Participation recognizes and acknowledges that there are certain unpreventable dangers and risks to which participant(s) may be exposed by traveling in another person’s company or company’s airplane, boat, and/or vehicle to and from as well as within and without, state of New York from the state of North Carolina as well as by participating in Bailey’s 2026 VIP New York trip.

The risks associated with the Bailey’s VIP Trip Include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, airplane travel, vehicular traffic, and auctions of other individuals, including but not limited to, participants, officers, directors, employees, agents and third-party employees, and independent contractors unaffiliated with Bailey’s or controlled by Bailey’s in any way. Participant also recognizes that there may be other risks not presently known or reasonably foreseeable. The participant understands that Bailey’s does not require the participant to participate in Bailey’s 2026 VIP trip, but the participant freely chooses to do so, despite the possible dangers and risks and despite this Agreement.

In consideration of and in return for the opportunity to participate in Bailey’s 2026 VIP trip, Participant agrees, in Participant’s individual capacity, and on behalf of Participant’s family, heirs, executors, administrators, personal representatives, and agents, to assume all the risks and responsibilities surrounding Participant’s participation in Bailey’s 2026 VIP trip. Participant releases and indemnifies Bailey’s its parents, subsidiaries, affiliates and predecessors, successors, and assigns, and each of Bailey’s respective representatives, principals, officers employees, agents, and assigns from and against any and all present or future claims, actions, causes of action, liabilities, and demands of any kind which Participant may now have or claim to have or may hereafter have or claim to have against Bailey’s, including but not limited to negligence for injury to person or property that Participant may suffer, during Participant’s participation in the 2026 Bailey’s VIP trip.

Participant recognizes that agreeing to the terms of this Agreement means Participant is waiving rights, among other things, to sue Bailey’s, its parents, subsidiaries, affiliates, predecessors, successors, and assigns, and each of Bailey’s respective representatives, principals, officers, employees, agents, and assigns, for injuries, sickness, damages, and losses that Participant may incur during the participation of the 2026 Bailey’s VIP trip. Participant agrees and understands that the release provision of the Agreement binds Participant’s family, heirs, executors, administrators, personal representatives, and agents.

The participant understands that activities during the 2026 Bailey’s VIP trip may be photographed or recorded. Participant agrees to allow their image or likeness to be used for any legitimate purpose by Bailey’s, unless the participant verbally declines to be photographed or recorded.

The participant understands that jewelry purchases on this VIP trip are non-returnable items.

Participant represents that Participant is eighteen (18) years of age or older.
